The Accuracy of Eye Witness Testimony and Its Flaws

As citizens of the United States of America, we believe the U.S. is a very successful country compared to the rest of the world. For the most part, we also trust and respect our complex justice system. If a suspect is proven guilty by the court of law and claims he or she is innocent, we usually have more faith in the court's decision rather than what the suspect is trying to say. After all, we do want as many criminals as possible behind bars, right? If the crime committed was very disturbing such as murdering a child we become very furious and we want to make sure that someone pays for that. Once the court rules a guilty verdict against a suspect in such a horrible case, we feel safe for another day in our comfortable homes. All thanks to our perfect judicial system another criminal is behind bars.

The U.S. courts do often help protect the rest of society by locking up dangerous people. Unfortunately the system is far from perfect and innocent people receive guilty verdicts. These innocent people are torn away from their families, careers, free life and faced with humiliation. They often face many years or life behind bars and even the death penalty. Such a harsh punishment for the person who did not commit the crime. It is scary to think that anyone of us can fall in to this loop-hole in our judicial system where we can face time in prison even though we are innocent.

How could this happen, how can the court misjudge such life impacting cases and come up with the wrong verdict? Researchers had done many investigations on wrongful arrests, they found that the large majority of arrests were mistaken because eyewitnesses have pointed out the wrong people. Having as many criminals as possible behind bars in today's system comes with a price, the price of innocent people going to jail too. The emotional victims want someone to pay for the crime, as long as someone gets punished they will feel better. The victim will go home and feel safer, sometimes not realizing that an innocent person is paying a price so the victim can feel cozy.

The Accuracy of Eye Witness Testimony and Its Flaws

Many experiments conclude that jurors and law professionals rely a lot on eyewitnesses to come up with a guilty or not guilty verdict. Gary Wells (1998) researched forty special cases. In all forty cases DNA proved that all forty convicted suspects were innocent. In thirty-six of these cases eyewitnesses wrongfully accused the suspects. This is a major flaw with eye witness testimony. This is a crime in itself! First of all we are talking about forty people being wrongfully accused. More than three quarters of them are accused thanks to their "perfect memory" witnesses. This alone proves that eye witness testimonies should not be given as much credit as they are in today's justice system.

A real life example of the eye witness testimony flaw is the Harris and Adams case. A police officer pulled over a vehicle at night to let the driver know that his headlights were turned off. The driver pulled out a gun and killed the officer. Suspect Harris was found a month later denying that he shot the officer. Harris claimed he picked up a hitch-hiker who was driving the car and the hitch-hiker shot the officer. The second suspect Adams who was the hitch-hiker claimed he was innocent but three witnesses claimed they saw him shoot the officer because Adams had a mustache and long hair which fit in to their description. Although Harris confessed that he stole the car and the loaded handgun, Adams was charged for the murder because three witnesses claimed they saw a description of Adams shooting the officer. Years later, the freed Harris was charged for a different murder and confessed on death row that he also shot the police officer twelve years earlier. Adams was finally released after an innocent twelve year sentence. Three witnesses pointed the finger at the wrong person.

How can three different witnesses point at the wrong person? Human memory is not like video or photo camera that can bring up a clear picture later in time. Our memories are often distorted by our schemas and other factors. If we are missing a piece of the picture when trying to remember something, our mind will replace it with something else. In this situation we will have a skewed memory. It was dark outside when the officer pulled the car over, therefore we can only see parts of the situation. Our mind can fill in those dark spots with other schemas when we try to remember the situation at a future time. The other problem can be the biased questions that police officers and investigators ask the eyewitnesses. For example if the officer has seen the suspect in custody, the officer's questions to the witness may be biased by the suspect's true description. Unknowingly, the officer might even make hints as to whether the witness is on the right track for describing a similar description of the suspect.

Another study was done by Patricia Tollestrup, John Turtle, and John Yille. The study focused on how we acquisition or pay attention to a certain scene, how we store that information and how we retrieve it later from our memory. They studied cases where the suspect confessed to the crime. These cases had eyewitness bystanders and eyewitness victims. The bystanders proved to have a more accurate memory of the crime scene than the victims involved. 100% of the bystanders remembered if the suspect had facial hair, only 60% of the crime victims remembered this correctly. Only 48% of the bystanders and 38% of the victims involved remembered the hair color of the suspect. The worse part is that both the bystanders and the victim eyewitnesses chose the right criminal 48% of the time in a lineup. This study shows that eyewitness testimony is very weak. It also shows that if the eyewitness was the victim of the crime, chances are their testimony is even weaker because of many factors that bias their memory. Another major reason why eye witness testimony should not take as much weight as it does today.

Jurors in a court case often don't realize the imperfections of eye witness testimony. They don't realize how imperfect our memories can be. If the jurors hear a great deal of confident detail about the crime from the witness, the jurors can easily be convinced by such a testimony. In an unusual event such as a short crime scene, a witness only collects pieces of the scene and later tries to put it altogether in to a story. Another conflict we have with memory is cross-racial identification. We have more difficulty identifying someone of another race other than ours. For example a black witness might have a harder time identifying a white suspect because blacks find it easier to differentiate between blacks. A black witness will have a harder time differentiating between whites the same as whites will have a tough time differentiating between Asians or Hispanics.

Another flaw that sometimes if not often puts innocent people in jail is the confident testimony of a victim that was seriously hurt or violated (Loftus). When this victim says with confidence "this is the guy that did it, I will never forget that face..." it is hard not to discredit their feelings and the fact that they lived through that horrible crime. Therefore it becomes easy to go with their testimony. A huge problem that Elizabeth Loftus talks about is the fact that judges will often not allow an expert to testify to the jury about the flaws of eyewitness testimony. Some judges will allow it, but others will make excuses as to why this expert testimony is not allowed. This leaves the jury uneducated about eyewitness flaws which potentially leads to a wrongful verdict.

When further researching the subject, I was amazed at some of the statistics I read about the inaccuracy of eye witness testimony. This is even if the crime occurred in broad daylight and there were many witnesses. I was also amazed at how much the courts rely on witnesses. Elizabeth Loftus went on to explain that when a judge decides not educate the jury of memory inconsistency of eyewitnesses, the jury for the most part decides the verdict from their "gut feeling". They ignore the balance that needs to be present between physical scientific evidence and witness testimony. The jurors without the simple education rely too heavily on the witness. This leads the jurors to make the wrong decision and possibly convict the wrong person. Another great point that was made by Loftus is the repetition of seeing the accused person. When the victim spends time seeing the person in photos, in lineups, in the courtroom, the suspect even if truly innocent becomes encrypted more and more in the victims memory. This makes it possible that if the victim saw the true criminal he or she probably wont recognize the criminal anymore especially if the victim saw the criminal once for a short time during the crime.

Our ability to remember accurately is not as reliable as we think it is. We are often unaware that our memories change which causes us to change the story from what really happened. We often forget the importance of the factors that can skew our memory and perception. Unfortunately we think factors such as confidence and details are more important and reliable when in fact these factors cause errors in decision making. When a case is made, the court system and the police should not rely so heavily on eye witness testimony, they need to continue to find more evidence in a case even if there are witnesses who sound like they have a good story.

Greek Mythology Hercules - The Mortal Who Became a God

When Hercules was born to Alcmene, she named him Herakles. But in Roman, Herakles is pronounced Hercules, which is the name we use for Hercules to this day. Hercules in Greek mythology is a great figure of valor and muscle strength. Hercules bravery earned him a place among the gods. After he left the mortal world, he found a position on Mount Olympus, the gods' dwelling place.

Zeus, the King of the gods was an unfaithful husband. He had a weakness for worldly pleasures. He fell in love with Alcmene, the wife of Amphitryon. In a short time, Alcmene conceived Hercules. This angered Hera and she tried to kill Hercules. Hercules survived his first fatal assault with a miracle.

When Hercules reached adulthood he became a famous warrior. He also fell in love with a beautiful woman called Megara. Megara became the mother of Hercules' children and together they made a happy family. However, things were to be different. Hera took a vow to irritate Hercules during his lifetime. She tricked Hercules into a wild rage. In his rage, the mortal god Hercules killed his family. This was exactly what Hera wanted!

Greek Mythology Hercules - The Mortal Who Became a God

When Hercules returned to his normal state of mind, he saw things were beyond remedy. He prayed to Apollo to get rid of his crime. Apollo was the sun god who could read into the future. We find in Greek Mythology that Hercules requested his advice. Apollo assigned him ten important tasks (later it was turned to twelve) as the way of purifying his soul.

The Delphic oracle sent him to Tiryns where the king Eurystheus ruled. Hercules was expected to serve him as laborer for twelve years of his life. However, the difficult service was not fruitless. Apollo promised him immortality. He was to become a god. However, the great Hercules of greek mythology had one problem, Hera. She actually kept her promise to make Hercules' life as wretched as she could. Nevertheless, with the assistance of Hermes and Athena, Hercules pulled off his term of twelve years with excellence. In addition, he became the greatest mortal on the earth to become a god.

Hercules In Greek Mythology - What Made Him So Special?

The honorable penance of Hercules and his eventual success is what makes him so special. His success brought him immortality, which would have been unthinkable for ordinary mortals. Hercules' first task was to peel off the skin of the horrifying Nemean Lion after capturing one. His next task was to kill The Lernean Hydra. The Lernean Hydra was a serpent with nine heads, which never gave peace to the lives of those around it. The third task for him was to bring a Hind (a sacred red deer) from Ceryneia to the king. The deer was the pet of Diana, the Moon goddess.

The fourth task for Hercules was to bring a live Erymanthian Boar. It was very dangerous to men and animals living around the mountain Erymanthus. Then Hercules was asked to clean up King Augeas' stables in one day. Are you thinking what is so great about it? King Augeas had an awesome amount of cattle of cows, bulls, goats, sheep and horses. Hercules proposed to King Augeas that he would clean the stable only if he rewarded Hercules with a tenth of his cattle.

After this success, Eurystheus was planning to make something tougher for Hercules. He commanded Hercules to force out an enormous flock of birds, which assembled at a lake near the town of Stymphalos. Goddess Athena helped him with a pair of bronze krotala, an item similar to castanets. The Cretan Bull was an easy task for Hercules. Hercules wrestled the bull, and then delivered it back to King Eurystheus.

The eighth task was to bring the Man-Eating Horses of Diomedes. It was followed by the battle against the Amazonian female army to get the belt of Hippolyte, the queen. The tenth labor was an awesome one. Hercules had to go around the world, to bring the cattle of the Monster Geryon. It had three heads and three sets of legs all attached at the waist.

The tricky assignment was the eleventh one. Eurystheus asked Hercules to get the Apples of the Hesperides. These were the golden apples gifted by Hera to Zeus. These apples were strictly guarded by a hundred-headed dragon, named Ladon, and also by Hesperides, daughters of Atlas. The other obstacle was that Hercules had no idea where these apples of Hesperides were located. Eventually, Hercules found the location from Nereus whom he seized until Nereus gave him the location of the apples of Hesperides.

Then Hercules found out through Prometheus, whom Hercules had helped, that he would have to have Atlas retrieve the apples. Hercules agreed to hold the sky and the earth while Atlas retrieved the apples. When Atlas returned with the apples, he told Hercules that if he would hold the sky and earth for the rest of time, that he would take them to Eurystheus himself. But Hercules fooled Atlas by asking him to hold the earth until he padded his shoulders. Atlas took Hercules place holding the earth, and Hercules picked up the apples and ran.

After making the great Hercules do all sorts of unbelievable errands, Eurystheus made sure that he did not succeed the last time. So, he ordered Hercules to abduct Cerberus, the underworld beast. Did you ever hear a living man visiting the Hades? However, Greek mythology tells us Hercules was no ordinary man. He was a hero.

He eventually did complete all the tasks, purified his soul and rescued the princess of Troy from a ravenous sea-monster. He also facilitated Zeus to beat the Giants in a great battle for the control of Olympus. He married again, to the charming Deianira. She presented him a cloak, which was coated with what she mistakenly thought to be a magic love potion. She was told that the balm would make the person love her forever.

Ironically, it was poison, which burned Hercules skin. Hercules, not being able to endure the pain asked his friends to kindle a fire. Then Hercules placed himself on the fire to be burned up alive. But the gods looked down, and Zeus thought that Hercules had suffered enough. So he asked Hera to end her anger toward Hercules, which she did. Then Hercules was brought to Olympus in Athena's chariot by Zeus' request.

This Greek mortal Hercules is undoubtedly the greatest hero of Greek Mythology. Hercules is still considered to be the perfect mythical character.

Who Was Jezebel?

The bible introduces us to Jezebel as the powerful & manipulating wife of King Ahab. Ahab was the king of Israel, but the Bible says Ahab son of Omri did what was evil in the Lord's sight, even more than any of the kings before him. Ahab also married Jezebel, the daughter of King Ethbaal of the Sidonians, and he began to bow down in worship of Baal (The male deity of power and sexuality).

First, Ahab built a temple and an altar for Baal in Samaria, then Ahab set up an Asherah (The female goddess of fertility, love and war pole). Ahab did more to provoke the anger of the Lord, the God of Israel, than any of the other kings of Israel before him. The worship of Baal and Ashtoreth included temple prostitution where both men and women would do sex acts to raise money for religious activities in the temple.

Jezebel was a Phoenician priestess who saturated Israel with the worship of Baal, Asheroth and other pagan gods. Over 450 prophets of Baal and 400 prophetess of Ashtoreth served Jezebel in her abominations of sex practices during the reign of Ahab. The Jezebel spirit is a demonic spirit of perversion, lust, manipulation, mind control, witchcraft and the occult. The Jezebel Spirit In The Church

Whether we recognize it or not, we see the Spirit of Jezebel operating everyday in our workplaces, our families and sadly enough even in our churches! When I was a young girl growing up in the pentecostal church, I was always told that Jezebel was a woman of the world who wore red dresses, bright red lip stick and who painted her nails red. This was the image of Jezebel that many of us grew up with in our minds and the image that some of us still believe to be true.

Sadly there are so many pastors that are manipulated and controlled by this deadly spirit. The Jezebel spirit hates the prophet and the prophetic voice. She will do anything to discredit and kill the prophet with her murderous spirit. Jezebel is a witch and she uses her witchcraft to control and set up her kingdom within the church.

You will see where this spirit will come in and befriend the pastor and his wife along with others in leadership. It never deals with the people it feels has no significance, other than to use them as her puppets and eunuchs. This spirit operates and moves like a snake and operates with the spirit of python. It will seem to be very friendly. It will charm you with gifts, generous monetary offerings and it will be available for any and everything the leader needs and wants. It is just when she has the trust of leadership and has directed her aim at heart that she strikes and bites spreading her venom.

The Jezebel will always have followers or what she likes to call her children. The children are just as dangerous to the church as she is. She will use these followers to spread the venom throughout the congregation. Lies, confusion, strife, adultery, fornication, homosexuality, competition and hatred are just a few of the manifestations a church will begin to see when a Jezebel spirit is in operation a church. There have been many churches that have split and were totally destroyed by this spirit. Once this spirit has gained control over a church, it takes a tremendous amount of spiritual warfare, prayer and fasting to become free. Here are some characteristics of the Jezebel spirit that can help you to identify the spirit.

10 Characteristics of the Jezebel Spirit:

1. It seeks to gain popularity and favor with people of influential and high positions of leadership.

2. It will seek out other individuals they feel are "weaker" to become followers of them.

3. It is never humble. Whenever this spirit receives praise, it always responds in false humility.

4. It is defensive and combative whenever confronted about anything.

5. It loves to teach and seeks to gain control in every situation.

6. It wants to be seen as the most spiritual and powerful one~typically loves to pray elaborate long prayers

7. It will not submit to authority

8. It loves to pray and impart evil demonic spirits into others especially in the church

9. It hates the voice of the prophet and seeks to control and destroy those who operate in the prophetic.

10. It will never repent!

Walk In Freedom

The Jezebel spirit must be confronted and exposed in order to end the manipulation and rule. If you can recognize any of the characteristics of the Jezebel spirit in your life you can begin by humbling yourself and pray to God for forgiveness. Repent for any ways that you have yielded yourself to be used by the spirit of Jezebel. Begin to walk in the truth of God's word and the light of Jesus Christ will begin to lead you out of those dark places and your deliverance will begin a new work in you.

Who is Mother?

This is a question most of us would have never thought about as we take our mother for granted. She has been there always to take care of us. Speaking of definitions of mother, there is ample number of definitions expressing closely associated thoughts on the question what is mother?

Biologically mother is a female person, whose egg unites with a sperm, resulting in the conception of a child. A mother is the biological and/or social female parent of an offspring. In the case of a mammal such as a human, the mother gestates her child, which is called first an embryo, and then a fetus. This gestation occurs in the mother's uterus from conception until the fetus is sufficiently developed to be born. The mother then goes into labor and gives birth. Once the child is born, the mother produces milk in a process called lactation to feed the child.

Who is Mother?

To the question "who is mother" there are many technical definitions. One definition says that mother is a woman who has given birth to a child. Another technical definition says that a mother is the natural or social female parent of an offspring. Mother is the woman to whom one was born. A female person who is pregnant with or gives birth to a child is called as a "would be mother" or a mother to the new born respectively.

Who is mother: Adoption of the child

It is not always necessary that somebody can only become mother if she has biologically given birth to an offspring. A woman who adopts and raises a child is more than a mother to that child. In animal kingdom also mother is referred to the female parent of an animal.

Mother is a term or a relationship which carries lot of respect and is closely associated with birth, nurturing, love, compassion, empathy and forgiveness. Further mother is also referred to one's female ancestor, a woman who holds a position of authority and responsibility, a title for women respected for her wisdom and age and women who creates, originates or founds something.

Mother is also given as a symbol to a creative source, an origin and emotions like maternal love and tenderness, compassion, empathy and nurturing.

1. Mum or mummy, is used in the UK & parts of Canada (especially Eastern Canada), Australia, and New Zealand; and also in some parts of Western Pennsylvania.

2. Mom or mommy, in most of North America (especially the U.S.). Mommy is considered baby talk. Most adults in these regions switch to the term mom as they approach the teen years. This term is also used in the British West Midlands.

3. Mam or mammy, North Wales, the South Wales valleys, Ireland, North and the East Midlands of England;

4. Mama and ma, in parts of the Middle East, Latin America, other Spanish-speaking cultures and The Netherlands. Mama is often used in rural areas of the midwest and south eastern regions of the US. Ma is a common term in various parts of the US including the north east.

5. In many other languages, similar pronunciations apply; maman in French and Farsi (Persian),maadar in Farsi (Persian), or mamma in Italian, or mãe in Portuguese. Mama, borrowed from the English, is in common use in Japan. In Hebrew the word is eema, and in many south Asian cultures and the Middle East the mother is known as amma or oma or ammi or "ummi", or variations thereof. Many times these terms denote affection or a maternal role in a child's life. The word originates from the Sanskrit mothru or motharaha and has taken various forms all over the world.

9. There are societies where when students graduate from their school, their teachers exhort them to consider first their mothers, followed by others, as embodiments of God.

10. Pregnant women have special privileges in many societies due to the high regard for motherhood.

11. The sanctity of motherhood was so highly regarded in many cultures that it was also extended to the animal kingdom. It was forbidden to hunt pregnant animals.

12. Reverence is also manifested in our seeing the Divine Mother in Nature, rivers and earth that nourish us.

13. Whatever may be the crime of one's mother, she is always one's mother and deserving of her children's love and respect. How can we ever condemn her who nurtured us for nine months in her womb, and underwent great pains to give us birth, and to bring us up in our childhood.

After all the definitions and expression of thoughts on Mother, I still feel that "who is mother" is a question that cannot be answered satisfactorily by words and one has to experience the love, nurturing, compassion and empathy of a mother at a personal level to know what is mother. That is the glory of the mother and that is "what is mother".
